At COMERCIAL ARJA, SA (hereinafter referred to as ARJA), we work to ensure privacy in the processing of your personal data. In this regard, we have updated our privacy policy to clearly inform you about how we collect, use, and safeguard the data of individuals who contact us.

ARJA, in accordance with the current regulations on the protection of personal data, Regulation (EU) 2016/679 of April 27, 2016 (GDPR) on the protection of individuals concerning the processing of personal data and the free movement of such data, Organic Law 15/1999, of December 13, on the Protection of Personal Data (LOPD), and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSICE), has implemented all security measures, both technical and organizational, established in Royal Decree 1720/2007 of December 21 (which develops the LOPD) to ensure and protect the confidentiality, integrity, and availability of the data processed.

PURPOSE

For the purposes of the GDPR LOPD, we inform you that the data you voluntarily provide to us on this platform and through any other means will be incorporated into our information systems in order to carry out the necessary commercial and administrative management.

The operations planned to carry out the processing are as follows: to provide requested services and to respond to your inquiries or requests.

We may also use your data to provide you with information and offers about our services, send you communications, newsletters, activities, and news of interest related to the company and its sector of activity.

DATA RETENTION

The data will be kept for as long as the contract or commercial relationship is in force and for the purpose for which it was obtained, and until you exercise your rights of opposition and/or cancellation as indicated.

Once the aforementioned relationship has ended, the data may be kept for the time required by applicable legislation and until any responsibilities arising from the contract are time-barred.

LEGAL BASIS

The legal basis for the processing of your data is the provision of contracted services and/or the response to your inquiries or requests.

The processing of your personal data to send you informational circulars, communications, newsletters, activities, and news of interest related to the contracted service is also legitimized by virtue of the existing commercial relationship with ARJA, in accordance with the provisions of the European Data Protection Regulation.

CONFIDENTIALITY AND DATA RECIPIENTS

The data you provide us will be treated confidentially. ARJA has taken all necessary protection measures to ensure the security of the data processing and to prevent its alteration, loss, unauthorized processing, or access, taking into account the state of the technology and the nature of the data stored. Likewise, it is also guaranteed that the processing and recording in files, programs, systems, or equipment and centers comply with the requirements and conditions of integrity and security established in the current regulations.

The data will only be accessible to company personnel who require it to carry out their job functions.

ARJA will not transfer personal data to third parties, except as required by law. However, if they were to be transferred to a third party, prior information would be provided requesting express consent for such transfer. The entity responsible for the database, as well as those involved in any phase of the processing and/or the entities to which they have been communicated—always with the corresponding authorization granted by the user—are obliged to observe professional secrecy and adopt the levels of protection and the necessary technical and organizational measures at their disposal to guarantee the security of personal data, avoiding, as far as possible, unauthorized access, unlawful modifications, theft, and/or loss of data, in order to ensure the corresponding level of security of the provider’s files, according to the nature and sensitivity of the data provided by the interested parties.

RIGHTS

ARJA guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPD to protect the rights and freedoms of the data subjects.

Any person has the right to request from the data controller confirmation of whether we are processing their personal data.

Data subjects have the right to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

Under the conditions provided for in the General Data Protection Regulation, data subjects may request the restriction of the processing of their data, portability in a structured, commonly used, and machine-readable format, and finally, the erasure thereof.

Under certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. If consent has been given for a specific purpose, it may be withdrawn at any time, without affecting the lawfulness of the processing based on consent prior to its withdrawal. In such cases, we will cease processing the data or, where appropriate, cease to do so for that specific purpose.

You are also informed that you may lodge a complaint directly with the Spanish Data Protection Agency (www.agpd.es) or another competent supervisory authority. You can also obtain more information about your rights by contacting the aforementioned organizations.

ARJA will clearly and intuitively inform users of the data that are mandatory and necessary to provide.

By indicating and entering the data, the user gives unequivocal consent to ARJA to process the data provided for the mentioned purposes.

Failure to provide the requested personal data or not accepting this privacy policy implies the impossibility of subscribing, registering, or receiving information about ARJA’s products or services.

In accordance with the provisions of the current regulations on the protection of personal data, ARJA is complying with all the provisions of the GDPR and LOPD regulations for the processing of personal data under its responsibility, and manifestly with the principles described in art. 5 of the GDPR and art. 4 of the LOPD, which are treated lawfully, fairly, and transparently in relation to the data subject and are adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.

ARJA reserves the right to update, modify, or delete the information contained on its various platforms, and may limit or not allow access to the information.

ARJA also assumes no responsibility for the information contained on third-party websites and platforms that may be accessed through links from any ARJA platform.

The presence of links or links is for informational purposes only and in no case implies suggestion, invitation, or endorsement of them.

We also inform you that the photographs posted on any platform are the property of ARJA.

PRIVACY POLICY CHANGES

ARJA reserves the right to modify this policy to adapt it to legislative or jurisprudential developments.

COMMERCIAL EMAILS

In accordance with the LSSICE, ARJA does not engage in SPAM practices; therefore, it does not send commercial emails by email that have not been previously authorized by the affected party or that result from having contracted a service. Consequently, in any of the forms that may appear on this website and other platforms, the user has the possibility to give their express consent to receive information from ARJA, regardless of the specific commercial information requested.

LEGISLATION

In general, the relationships between ARJA and users of any of its telematic services are subject to Spanish legislation and jurisdiction, to which the parties expressly submit, with the courts and tribunals of Lleida being competent to resolve all conflicts arising from or related to their use.
